Hi everybody! Lu Bracher here from Real Estate HQ. I am going to run through some key changes to the new
1st of May 2025 Legislation changes in relation to the RTA rental application process so for those of you that are not aware, from May 1st 2025 we are now legislated. To ensure that we comply with a new privacy and application process to this effect, the RTA have issued an rental application online which is Form 22 to be used for processing new tenant application.
My understanding of it is that, you are still permitted to use that as long as it lines up and it does not contract out of the requirements of the new form itself. So best practice would be obviously to use the RTA forms but with addendums into it so that the tenants are visually able to see that the form that they are using is an RTA form. But the extra items that are there show them that it is not going to breach whatever the original form is. So if you get what I mean, so key things are the kind of documentation that you can request they are limited to two each
the way that they are able to submit the application, you have to provide them with two options.
To submit the application, you are only allowed to ask for 2 sources of identity documents you are only allowed to ask for 2 sources of income. You are only allowed to ask for 2 sources of personal references you must disclose to the tenants, which databases that you are going to check the tenants on and they are able to contact the particular tenancy databases and verify it. Rental references from previous landlords or previous agents.
I don’t see any concerns in that because you’ll need to see what their tenant history has been like in order to validate their suitability.
But on the application form, there is nowhere where you are allowed to ask them if they’ve ever been in arrears.
Now with the identity documents, you need to delete that and everything associated with that within 3 months of them being notified. If they’ve not been approved and i’ve been saying that there is a part at the very end
for office use only on the Form 22 of the RTA document that literally you need to tick and flick these. So I believe you’re going to need to use this form because if anybody comes back and says that you’ve actually breached their non-compliance of for example the destruction of the documentation process. These documents in there
but in saying that even if we deleted it, it’s gone. We don’t have anything any proof anyway. So another waste of time maybe I don’t know.
Anyway, it is there you need to be aware of it. If you have any concerns
